Terms and Conditions

These terms govern your use of Merlin Archive at merlinarchive.uk. By using the site you accept these terms. If you don't accept them, please don't use the site.

Who we are

Merlin Archive is a public-interest archive of UK military vehicle records, operated by Robert Wilson, a sole trader trading as Merlin Archive, based in the United Kingdom. You can contact us at info@merlinarchive.uk.

Using the archive

The archive is free to use. You can search by ERM, browse vehicle records, and view images contributed by former crews and members of the public. Some features — saving vehicles to your garage, submitting ERMs, uploading images, viewing certain restricted fields — require a free account.

A small number of features are reserved for accounts that have made a donation. These additional permissions are not contractual; they reflect our gratitude for support, not a paid service. We may change which features are donor-only from time to time.

Daily limits

Guest visitors and registered users are subject to a daily view limit on individual vehicle records. The limits are shown on the search page and may be adjusted from time to time to keep the archive sustainable.

Account registration

To register you provide your name, email address, and a password. By registering you confirm that:

We may suspend or close accounts that breach these terms, attempt to disrupt the site, or post inappropriate material.

Acceptable use

You agree not to:

User-submitted content

When you submit material to the archive — images, vehicle service-history entries, B-card scans, or other content — you grant Merlin Archive a perpetual, worldwide, royalty-free, sublicensable licence to use, display, distribute, adapt, and reproduce that material for any purpose, including commercial purposes.

By submitting material you confirm that:

You can ask us to withdraw your submission at any time by emailing info@merlinarchive.uk. We'll action withdrawal requests within 30 days. Material that we have already distributed off-site (for example, in print) before the withdrawal request can't always be retracted, but we won't continue to use it on the archive after the request.

Donations

Donations are processed by PayPal. They are voluntary and non-refundable. They do not create a contract for goods or services. You don't receive anything in exchange for a donation other than the additional account permissions described above, which we may change at any time.

If you donate by mistake or in genuine error, contact us within 14 days and we'll consider a refund on a case-by-case basis.

Open Government Licence

Vehicle records derived from Ministry of Defence releases are made available under the Open Government Licence v3.0 (nationalarchives.gov.uk/doc/open-government-licence/version/3/). This licence allows you to copy, publish, distribute, and adapt the underlying public-sector information, provided you acknowledge the source.

The OGL applies to the public-sector information in the records, not to user-submitted material (images, service-history entries, B-card scans), which is licensed to us under the user-submitted-content terms above.

Intellectual property

The site design, code, search interface, and all aggregated, edited, or curated content are the intellectual property of Robert Wilson trading as Merlin Archive. Public-sector information is OGL-licensed. User-submitted content remains the property of the contributor, licensed to us as described.

No warranty

The archive is provided as-is. We do everything we reasonably can to keep the data accurate, but we don't warrant that the records are complete, error-free, or fit for any particular purpose. Many records are based on historical sources that contain errors, and the archive is built and maintained on a volunteer basis.

If you spot an error, please tell us via the contact form so we can investigate.

Limitation of liability

To the maximum extent permitted by law, Merlin Archive's liability for any claim arising from your use of the site is limited to:

Nothing in these terms limits our liability for matters which cannot be limited under English law (such as personal injury caused by negligence, or fraud).

Termination

You can close your account at any time by emailing info@merlinarchive.uk.

We can suspend or close your account if you breach these terms, or if continued operation of your account would put the archive at risk. Where reasonable we will tell you before doing so.

Changes to these terms

We'll update this page when our terms change. The "last updated" date at the top reflects the most recent revision. Material changes will be flagged via a notice on the homepage for at least 30 days. By continuing to use the site after a change, you accept the updated terms.

Governing law

These terms are governed by the law of England and Wales. Any dispute that cannot be resolved between us will be subject to the exclusive jurisdiction of the courts of England and Wales.

Contains public sector information licensed under the Open Government Licence v3.0. Photographs are copyright their respective owners and used by permission of the contributor unless otherwise stated.
